MOH: ‘The Non-Saudi Investor Can Own a Hospital by Virtue of Law’

The Ministry of Health (MOH) has highlighted that the non-Saudi investor can own a hospital by virtue of law, pursuant to the Royal Decree No. (M/36), dated 11/6/1434 H, approving of the amendment of Article (2) of the Private Health Institution Law. Article (1) reads: “The ownership of any private health institution, other than hospitals, must be limited to Saudis.”
 
Accordingly, the MOH is applying what has been stipulated in Article (2) of the aforementioned law; that the non-Saudi investor can own a hospital, while MOH has never issued any regulations contradicting to such meaning. Meanwhile, the Ministry has pointed out that Article (2) of the above mentioned Law stipulates the non-physician Saudi investor can own a medical complex.
 
It is worth mentioning that the executive regulation, which has been released recently by MOH based on Article (32) of the Private Health Institution Law, stipulates that the Minister is to issue the regulation clarifying that law, and that there is nothing in the executive regulation contradicting, neither explicitly nor implicitly, with the aforementioned texts.
